Terms & Conditions

1 . ENTIRE AGREEMENT: This agreement contains the entire understanding between the COMPANY & the CLIENT. It supersedes all prior & simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing via email & confirmed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid & enforceable.

2. RESERVATION: A signed contract & deposit are required to reserve the dates & times of the EVENT(S). If the EVENT(S) are rescheduled, postponed, or cancelled; the retainer fee is non-refundable. This bullet point refers to non COVID-19 related scenarios. Please refer to the COVID-19 page for terms in COVID-19 scenarios.

3. EVENT SCHEDULE: The client agrees to confirm the schedule one-week prior to the EVENT(S). Notification of any changes in schedule or location must be made in a timely manner via email to the COMPANY by the CLIENT.

4. SHOOTING TIME / ADDITIONS: The CLIENT & the COMPANY agree that shooting commences at the scheduled start time & ends at the scheduled end time. All additional time beyond the scheduled end time will be billed to the CLIENT at £200/hour.

5. RESPONSIBILITIES: The COMPANY is not responsible for compromised coverage due to causes beyond the control of the COMPANY including but not limited to obtrusive guests, lateness of the CLIENT or guests, weather conditions, schedule complications, incorrect addresses provided to
the COMPANY, rendering of decorations, or restrictions of the locations. The COMPANY is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. The COMPANY is not held liable for missed coverage of any part of the EVENT(S).

The COMPANY will not be held accountable for failure to deliver images of any individuals or any objects at the EVENT(S).

6. VENUE & LOCATION LIMITATIONS: The COMPANY is limited by the rules & guidelines of the location(s) & site management. The CLIENT agrees to accept the technical results of their imposition on the COMPANY. Negotiation with the officials for moderation of guidelines is the CLIENT’s responsibility; the COMPANY will offer technical recommendations only.

7. PERMITS: The CLIENT is responsible for acquiring all permits & necessary permission for all locations on which the COMPANY will be performing services.

8. PHOTOGRAPHER EXCLUSIVITY: The COMPANY will not work under any circumstances if another photography company is hired for the very same EVENT(S). Furthermore the CLIENT gives full priority to the COMPANY in relation to capturing the event over any video/cinematography teams that are hired simultaneously for the same EVENT(S). This ensures that guests attention will be towards the photographer & will result in
optimal results for the COMPANY.

9. FILM & COPYRIGHTS: The photographs produced by the COMPANY are protected by Copyright Law (all rights reserved) & may not be reproduced for publishing or selling in any manner without the COMPANY’s explicitly written permission. The COMPANY grants the CLIENT permission to print the images for personal use, share the images on social networking websites, with family & friends, & on vendor websites as long as the images remain unaltered & textual credit is explicitly given to the COMPANY.

10. MODEL RELEASE: The CLIENT hereby assigns the COMPANY unrestricted right to use & publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising, educational & any other purpose & in any manner & medium.

11. LIMIT OF LIABILITY: In the unlikely event that the assigned photographer from the COMPANY is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of the COMPANY, the COMPANY will make every effort to secure a replacement. If the situation should occur & a suitable replacement is not found, responsibility & liability is limited to the return of all payments received for the EVENT(S). In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the COMPANY’s control, including but not limited to camera, hard drive, or equipment malfunction, the COMPANY liability is limited to the return of all payments received for the EVENT(S).

12. Online Highlight Gallery: The online highlights gallery (if a part of the agreed contract) will go live approximately 72 to 96 hours after the final event. Images that narrate the story of the event on the day will be chosen by the COMPANY. The gallery will have a unique link & will be password protected for the clients and guests to access. The images shown in the gallery will be available for the CLIENT and their guests to download in a small format with watermarks for social media and personal use. The CLIENT and their guests will also be able to purchase prints via the galleries print store functionality. The gallery will be live for 12 months after it’s launch date, if the CLIENT would like to extend the gallery’s online period, it is a standard rate of £75 for 12 months thereafter.

13. POST PRODUCTION & EDITING: The final post production & editing styles, effects, & overall look of the images are left to the discretion of the COMPANY. Images within the album will be optimized, but will not be physically manipulated. This means images can be cropped & colours can be boosted, but altering backgrounds, removing foreign objects, removing people from pictures will not take place. Brightness of peoples faces can change due to flash settings & external light, please do not ask us to change skin color.

14. DIGITAL FILE DELIVERY; The COMPANY will supply all images in JPEG format in full size/resolution & watermark free via a USB stick on album delivery. The COMPANY does not supply RAW files.

15. PAYMENT SCHEDULE: The 50% non-refundable retainer fee is due at the time of signing of agreement. The remaining balance is payable in full 30 days after the final EVENT takes place. In the event the CLIENT fails to remit full payment as specified, the COMPANY shall have the right to immediately terminate this agreement with no further obligation & retain any monies already paid.

16. PRICING: Services or merchandise not included in this initial contract will be sold at the current price when the order is placed. All prices are subject to change at any time without notice.

COVID-19 Terms & Conditions

In the event there is no local quarantine/change of tier or restrictions or that venues do not cancel & the wedding date hasn’t changed, the COMPANY is committed to moving forward with the CLIENT’s wedding as originally planned.

If there is a change in tier restrictions within the area of which the venue is situated, hence prohibiting any of the CLIENT’S scheduled events, the COMPANY is committed to working with the COUPLE to reschedule to a new mutually-agreeable date which is in line with the regulations at the
time of the newly rescheduled event. The COMPANY asks the CLIENT to keep the COMPANY informed promptly & efficiently up to date during rescheduling discussions. Weekends over the summer (typically April – September) tend to book 12 months in advance due to popular demand. There is a higher possibility of date availability during off-season months (typically October – March) & weekdays (Monday to Thursday) throughout the year when rescheduling, therefore it is advisable & preferable to contemplate booking/rescheduling within these parameters.

In the event a new date is confirmed & the COMPANY can photograph the event, the COMPANY will send a new contract with the updated wedding date to officially secure the wedding date & all monies paid by the CLIENT will be forwarded to the new contract.

No wedding date changes are official until the CLIENT signs a new wedding contract for the new wedding date. New wedding dates are not guaranteed, until the contract is signed, available dates are offered on a 1st come 1st served basis & the COMPANY asks the CLIENT to please sign the updated contract / agreement as quickly as possible to avoid disappointment.

Unfortunately the COMPANY will not refund any monies in the form of deposits in the event of cancellation due to Covid-19, or rescheduling to a date the COMPANY is not available for. This is to protect the COMPANY since the COMPANY often have to turn down other bookings/opportunities at
the time, as well as having already made investments such as meetings, emails, timelines & other admin work. The COMPANY has a limited number of weekends per year to book weddings. The business depends on booking these dates to sustain itself for the year & to continue to grow as a business. For each date change, the COMPANY turns down other booking potentials that could have been on the day, & in turn a large percentage of future income. Additionally, by pushing dates back, the COMPANY is bearing the increased administrative costs (insurance, software, memberships, professional dues, office expenses etc). The COMPANY realises this would obviously negatively affect both parties & the COMPANY has no interest or desire in this happening to either parties. The COMPANY encourages the CLIENT to postpone the event instead of cancel.

As events have been required to downsize in guest numbers due to COVID-19, this will NOT affect the overall price of services given by the COMPANY. The same charge for services that were agreed upon before any changes to guest numbers, will still apply. The price of the service that the COMPANY provide is based on the quality of work, number of hours & post production time that is required; all of which will still be at a consistently high level of quality regardless of guest numbers. This however will be subject to discussion & negotiation if the hours of the event have changed for any reason due to COVID-19.

The COMPANY will be taking every precaution necessary in regards to protecting the CLIENT & guests by following the government guidelines. If the photographer shows any symptoms of Covid-19 beforehand, the photographer will not attend your wedding. The COMPANY will make every effort to fulfil the contracted services such as having additional photographers on standby.
